Much as I want to see the Director's Cut of Kingdom of Heaven, I'm not sure that accusing the studio of deliberate "bait and switch" makes sense.
What some people here seem to regard as false advertising may have been simply a matter of timing. Trailers, ads, tie-in books, etc. are often finalized long before the movie they refer to is in the can.
Nobody has ever accused the people who made the Lord of the Rings trilogy of bait and switch. Yet there are plenty of publicity materials for those movies that show shots not included in the theatrical versions (or in some instances, even the extended editions) of any of the films.
For example, the photo of Orlando Bloom as Legolas that appeared on the cover of the Two Towers paperback book comes from a scene that was not included in the theatrical version of The Two Towers. The Making Of book that came out with the first LOTR movie includes a shot of Liv Tyler and Cate Blanchett together that was never included in any version of the movies (indeed, these two characters are never even in the same scene). Yet there was no malice here. It just turned out that way.
I think things just turned out the way they did for Kingdom of Heaven, too.
I don't really like the idea of accusing Fox of doing anything other than making a decision that proved to be unfortunate.
What's important is that there's still a chance to correct that decision. This can be a win-win situation. A well-advertised limited theatrical release of the Director's Cut, followed by an equally well-publicized DVD release, would make everybody happy and give the excellent work of Ridley Scott, William Monahan, Orlando Bloom, Eva Green, Liam Neeson, and so many others the exposure it deserves.

"20th Century Fox will release theatrically a director's cut of Ridley Scott's Crusades epic "Kingdom of Heaven" today, the studio said Thursday.
The film, which centers on a young Frenchman (Orlando Bloom) who discovers his destiny as a knight amid the clash between Muslims and Christians over the Holy Land a millennium ago, will unspool exclusively at the Laemmle Fairfax Theatre in Los Angeles. For the new cut, Scott added 45 minutes to the original release's 145-minute running time.
"With his new director's cut, Ridley Scott has brought an exciting new dimension to 'Kingdom of Heaven,' " Fox president of domestic distribution Bruce Snyder said. "We're delighted to bring this new version of the film to the big screen, where it belongs."
The big-budget "Kingdom of Heaven," which was released in May, did only modest business at the domestic boxoffice with a $47.4 million haul. The film, however, resonated internationally, where it earned an additional $163.6 million.
The original cut also has become a breakout hit on DVD, where it topped both the DVD sales and rental charts its first week out in October (HR 10/20)."

Did Peter Jackson put trailer footage before audiences of completely excised subplots, footage that would have made the premise of the film to make more sense? Did he hint with officially released production material that characters existed, like Tom Bombadil, or that a sequence of the hobbits’s journey including him was shot, by flashing tempting little tidbits of it?
What's obvious to me from the reports that are coming from people who have seen the Director's Cut of Kingdom of Heaven is that two movies were indeed shot...why else would there have been substitute dialogue, such as Sybilla’s when approached by Guy at the King's deathbed? Apparently, it changed from "If I have your knights, you have your wife" to "If my SON has your knights, you have your wife" or a facsimile thereof; two distinctly different lines for Eva Green to speak for the same scene, and this happened more than once. These weren't voiced over, nor were others that indicate a deliberate effort of presenting two distinctly different films, which is what we have here. Were these scenes done as pick-ups once the studio knew they were going to be beheading and emasculating the film for the sake of box office opportunity? Or were they indeed shot in sequence to each other, because they knew all along it would likely be chopped to pieces and offered to us piecemeal? We’d like to know, and a close examination of continuity will tell in the end.
While the scene I just described, as well as other "rewritten" scenes which amputated a subplot may not have been in a trailer, the very fact that two sets of dialogue for the same scene even exists speaks to the MOTIVE of this studio, and possibly even to Scott's duplicity at least in the knowledge that one film was written and two versions were to be shot. The question is, when did they know, and was footage from BOTH used to flash images before us in early trailers and production stills just to put butts in seats in May 2005? Our leading man lounging shirtless in bed, or executing a sword fight as though it were a ballet; perhaps we were never meant to see these most tantalizing images until our last cent has been milked out of us. No, you won’t see his most shining moments, nor that of Eva Green or Liam Neeson, or Jeremy Irons until Fox has squeezed every last penny from our wallet. First, the theatrical cut in the cinema; then to Fox Home Entertainment (for the FIRST DVD, mind you) and finally, for the extended cut DVD, which they patronizingly release to a hole-in-the-wall dump in LA where NO ONE important is going to see it. WHY? To placate, and to say they did it.
I suppose this is the age of the extended DVD and it is to be expected as box office takes continue to decline? What I object to most is the whinging from studios at why box office is so weak and the way actors, who have busted their asses to make a film, must shoulder the BLAME for perceived box office failure when it was the intention of the studio ALL ALONG to draw out the earning potential of a film all the way to my home theater three years after its realease. And the fucking critics…blaming, slinging insults and engaging in attempts of to eulogize an actor’s career because a good bit of his performance was knocked to the floor and never seen while people are paying attention.
What I'm saying is that the film industry, NOT just Fox, has found a way to shoot the film they want, and sell it to us- THREE TIMES - before they show us the whole thing. Smart marketing? Of course; but deceptive, nonetheless.
I’ve had the pleasure of seeing the director’s cut twice now and I agree it is a far superior film. It’s important to point out that the “director’s cut” is a relatively new phenomena, which Ridley himself was one of the first to employ. The “director’s cut” is a luxury most directors don’t get and they almost never get re-released in theaters. The facts that this re-release was only announced in the Trades and was shown in one theater the last possible week for Oscar nomination consideration (normal procedure for this) shows that it was never intended as a litmus test for a wider release or even for critic’s viewing. Have you noticed how the only people talking about it are the internet movie sites run by fankids? This release was not targeted to critics at all but to academy members living and working in LA.
The idea that two movies were shot initially is wrong. First of all, the expense would have been astronomical. Secondly it would make the shoot schedule twice as long. The filmmaking process is pretty straightforward: you have your pre-production period where you sit down with the crew and plan out what you’re going to shoot and how, the production period where you shoot the script, the post production, and then release. During post is when the film is edited. After a rough cut is put together the director and some times studio executives watch the film and work out what holes need to be filled or scenes fixed. Re-shoots or pick-ups are shot, sometimes months after principle photography is done to be edited into the final cut. (We all saw how PJ was shooting pick-ups for all three Ring movies in the behind the scenes. And that was when and how the original Arwen storyline was altered.)
I have some questions and concerns about the ad. The timing seems late. It would have made more sense to place the ad while the movie was still in a theater (which may have even garnered a little more attention for the film and boosted attendance). It was suggested before to move the ad from the LA Times to say the Hollywood Reporter. That is logical since everyone in Hollywood reads the Reporter and vies to get ads and notices in it. It is such an expensive undertaking that will more than likely fall on deaf ears. If you are unsuccessful in raising the full amount and the ad does not get placed, will those who have contributed get their money back? If not, where will that money go?
There is no conspiracy to soak the movie going public for every cent they’ve got. Who out there went ahead and bought the theatrical versions of the Ring movies AND the extended versions and gladly did so? Word was out there about an extended KOH pretty much from the get-go, so none of this should come as a surprise to anyone. What is it then that is so upsetting? Ridley worked within the confines he was given and released the movie he could. In the end, when the DVD is released Ridley’s original vision will be realized. That’s the way this whole business works. Taking out an ad for an unprecedented theatrical release might be viewed as naïve and will be a disservice towards how Orlando’s loyal fans are perceived.

I had the honor of seeing Kingdom of Heaven in New York at the premiere in May. I was expecting a far better film than what I saw, because the trailer had hinted to an all together different movie. When Sir Ridley Scott was introducing the film, he did explain that the film was a highly edited version, and that a directors DVD would be released after the theatrical release. I have hesitated in buying Kingdom of Heaven on DVD because I am holding out for the Directors Cut. Please, I'd really not like to wait longer than I have to.
There was a time when movies were made to be seen by an audience in a theater and only in the theater. Studios put effort into these movies. They found talented actors, directors, producers, and crew to be in them, and make them. If these offerings were of an appropriate quality, people returned to the theater to see them again and again. This is an arrangement that worked well for some time. One chance to put your best effort forward and get a return from it.
With the advent of the VCR, came a second chance for the studios to make a return on their investments. For the first time, movie goers had the opportunity to not only see the movie at the theater but to purchase it and watch it at their leisure. It was not a concept that was embraced overnight but in time people discovered the convenience and economy of watching their favorite movie at home.
But something else was discovered by the studios and directors. A new market emerged when Close Encounters of the Third Kind was re-released as the Directors Cut. The marketing for that video in particular, set a precedent for directors and studios. Not only would movie goers purchase a movie, they would purchase it again in order to have new scenes and additional footage. The studio was no longer limited to that one release, that one window of time to gain back what had been invested. By repackaging and marketing, they had as many chances as they could sell the public on.
Now, there were some advantages to this. We had the opportunity to see those extra bits that the director toyed with and thought of as a possibility, but ultimately they did not go with. In the case of Close Encounters, we had the chance to see “Inside”. It was that little hook, that one thing we all longed to see but were denied in the theatrical release.
Here's the thing though, that moment in the theatrical release of Close Encounters, when we only watch Roy Nery walk on board the ship was the right one. It gave all of us an ending that prompted us to imagine and dream. We all had a vision of what was inside and in the end, when were handed that ending in the Directors Cut, it failed to meet what our imaginations had created. Regardless, this was the beginning of a trend, and one that has perhaps led to a decline in movie attendance and quality.
Why? Because now, there isn't the importance on the first time around with a theatrical release of a movie. The theatrical release is only the first stage of recouping the studios investment. After the theatrical release is the DVD release, and then, for those movies that can justify it, possibly an Extended or Directors Cut theatrical release, then a DVD of that. That's a potential of four times or at the very least three, a movie can go in front of the public for purchase. And it doesn't begin to touch the rental market.
Now, we've all enjoyed these releases, with the extra footage that expands the canvas of the original film. But the result is that there is a growing tendency for people to wait to see movies. They wait because, instead of just adding a more to a good move, the Extended DVD's have become the real movie. There's no need to see that first run. The public has come to realize that the best effort will come, not with the theatrical release but on the last release,the extended or Directors Cut DVD, and are willing to wait for that effort.
Rarely however, have we seen a movie so drastically changed by an Extended or Directors Cut. Typically we see scenes that have added that give a bit more depth, A few more moments that bring added dimension to the film we had originally viewed. With Kingdom Of Heaven though, we have indeed seen something altogether different. Not just a movie added to but a movie altogether changed.
Remember. Even as Kingdom of Heaven was released, there was talk of a DVD. During the promotion of the film there was discussion of how there would be things would be in the extended DVD, things missing from the theatrical release even as the movie was first being shown. To my knowledge this is a first. A champaign for an extended DVD, even as the theatrical release was being screened.
Now that the Directors Cut has been shown to the small, limited, audience that attended in LA, we know that the Directors Cut is far different from the theatrical release. It's not just added on to, not just embellished. There are drastically different story lines, characters have changed significantly, and completely new plots have emerged. It has become, a different movie.
Whether there was intent on the studio's part in doing this is a puzzle and likely to remain one. But we have to ask, what purpose did this serve? What reason is there to put forth the lesser effort, the lesser product? And more importantly, what does it mean to us as movie goers?
I don't know what classifies legally as “Bait and Switch”. I do know, that what was promoted, those images of the little boy in particular, was not seen in the movie I bought a ticket for. I don't know about conspiracy, but it is clear that there are scenes that are filmed with dialog to support the theatrical release and different versions of those scenes filmed to support the Directors Cut. I also know that as a movie goer, I find the entire situation to be extremely disappointing. There's little wonder as to the downward turn theatrical releases have been taking this year. If this is how studios want to make and release movie now, there's little reason for attending them in the theater, since we won't be watching a fully developed movie until the Extended or Directors Cut DVD is released.
